TERMS AND CONDITIONS
Thank you for choosing to fly with ElectricAir, provided by Electric Airline Limited (“we”, “us”, “our”). Below are our terms of conditions (Terms). These Terms apply to the individual booking with us, and to the individual flying with us (“you” and “your”). We hope these Terms are clear. If you have any questions, please get in contact with us.
By booking our services or flying with us you agree you have read, understood and accept these Terms. If you are booking on behalf of someone else, you warrant you have made such persons aware of, and they agree to, these Terms.
We may amend these Terms from time to time without prior notice. Changes to these Terms will apply to bookings made after the change is made.
1. BOOKINGS
1.1 Bookings are to be made online at www.electricair.nz (website) or via email correspondence and bank transfer payment. Full payment is required at the time of booking.
1.2 Once a flight has been booked and paid for this product is non-transferable (except as set out in our “Change Policy”) and non-refundable.
1.3 Bookings may not be changed to a date that is more than one year from the initial purchase date. Extensions may be provided at our absolute discretion, for example in the event of a postponement due to weather.
1.4 Once payment for your purchase has been received by us we will send you a booking confirmation in relation to your purchase. The booking confirmation will be sent to the email address that you provided at the time of your order. If you have not received a booking confirmation within 24 hours, please contact us so we can confirm your purchase.
2. PRICING
2.1 Prices are published on the website or sent to you by email. All pricing is displayed and charged in New Zealand dollars and includes GST. We reserve the right to alter published prices at any time. Pricing is on a per person basis, regardless of age.
3. GIFT VOUCHERS
3.1 We also have gift vouchers available to purchase. These will be emailed to you after purchase.
3.2 Gift vouchers are not refundable or redeemable for cash, and cannot be used in conjunction with any discounts or sale offers.
3.3 Gift vouchers are not transferable, and are valid for one year from the date of purchase.
4. ELIGIBILITY
4.1 If you are booking for a person under the age of 18, you are agreeing to these Terms on their behalf. Minimum age of 14 years.
4.2 You will need to confirm your weight and height when making the booking as the aircraft has operating limits. Maximum weight 105kg and maximum height 6ft 4in (1.93cm).
5. AVAILABILITY
5.1 We will try to find suitable times to meet your needs, however all bookings are subject to the availability of the aircraft and pilots, and to acceptance by us.
6. CANCELLATION POLICY
6.1 Flying is a weather dependent activity. ElectricAir or the pilot will make a decision regarding weather in the lead up to your booking. Whilst we make every effort to forecast conditions, if on the day the weather deteriorates and the flight cannot safely take place, it will be cancelled and another time arranged.
6.2 We reserve the right to cancel a booking if circumstances arise that are beyond our control, including if Covid-19 restrictions prevent or alter operations. This will be dealt with on a case by case basis at the time and special conditions may be introduced.
6.3 We reserve the right to cancel or postpone your flights for other reasons, including for safety, pilot availability, and/or aircraft availability.
6.4 In the event of postponement or cancellation in any of the above circumstances, we will work with you to reschedule the flight. We do not provide automatic refunds due to postponements, and any refund shall be at our sole discretion.
6.5 If you fail to arrive for your scheduled booking time your booking will be non-refundable. Please arrive on time.
6.6 We will not be liable for any loss caused by delay, disruption or cancellation as a result of any laws or regulations, adverse weather, fire, strikes, rebellion, terrorism, epidemics or any other cause(s) that are either unforeseeable and/or beyond our control.
7. CHANGE POLICY
7.1 Changes to your booking can be made by contacting us on the details in “Contact Us” section below.
7.2 You may change your booking more than 48 hours in advance at no additional cost.
7.3 If you change your booking with less than 48 hours, but more than 24 hours notice, you will incur a $50 change fee.
7.4 If you change your booking with less than 24 hours, you will incur a $100 change fee.
7.5 Any change to your booking will be subject to the availability of the aircraft and pilots, and to acceptance by us.
8. MEDICAL CONSIDERATIONS / DISABLED & IMPAIRED CUSTOMERS
8.1 You must inform us of any health conditions that may affect the safety of the flight prior to completing the booking. Please get in touch prior to booking if you would like to discuss flying with a disability, impairment or certain medical conditions.
9. EXCLUSION OF LIABILITY
9.1 We do not provide any warranties that our services will provide a particular level of enjoyment, meet your expectations or achieve a particular result.
9.2 You acknowledge that participation in our services may involve a degree of risk, including risk of injury due to turbulence, adverse weather, flight conditions or mechanical issues. You acknowledge that you are participating in our services with full knowledge of such risks.
9.3 To the maximum extent permitted by law you release us from all claims arising as a result of or in connection with our services. To the extent liability may not be limited under any applicable law, our liability in respect of any claim arising as a result of any acts or omissions under or in connection with our services or these Terms, whether caused by breach of contract, misrepresentation, negligence or any other tort, breach of statutory duty or otherwise, will be limited to repayment of the price paid for the flight.
10. INDEMNITY
10.1 You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities and expenses including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute incurred or suffered by us arising out of any breach by you of any provision of these Terms.
11. PHOTOGRAPHS AND VIDEO
11.1 You may be photographed and/or recorded during one of our flights. Photographs and video of you may be used by ElectricAir for promotional purposes.
11.2 You expressly grant us a licence to use any image or video for marketing or commercial purposes without any need to make payment to you.
11.3 If you do not wish to be included in any photographs or videos, please contact us prior to the flight.
12. OTHER CONDITIONS
12.1 Changing weather may result in a change of flight plan or duration at the pilot’s discretion.
12.2 The flight is an introductory trial flight or training flight, not a scenic flight.
12.3 You agree to comply with all reasonable instructions given by us while participating in a flight.
12.4 We may refuse your flight with us if we suspect that you have a transferable illness, are under the influence of alcohol or any other substance, or that you are engaging in disruptive or inappropriate behaviour. In such a case, no refund will be available to you.
